Terms of Service

1. Who we are

Tapview ("Tapview", "we", "us") is a service operated by BB Development B.V. (KvK 87675838), a private limited company registered in the Netherlands. These Terms of Service ("Terms") govern your access to and use of the website tapview.io and any related services (collectively, the "Service").

2. Acceptance of these Terms

By creating an account, uploading content, or purchasing content through the Service, you agree to be bound by these Terms, our Privacy Policy, our Acceptable Use Policy, and our Refund Policy. If you do not agree, you may not use the Service.

3. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to use Tapview. By using the Service you represent and warrant that you meet these requirements.

4. The Service

Tapview is a platform that allows creators ("Creators") to upload digital files, set a price, generate a shareable paid link, and receive payment from buyers ("Buyers") who choose to unlock the content. Tapview is a technology and payment-facilitation platform. Tapview does not own, create, endorse, or assume responsibility for Creator content.

5. Creator accounts and content

• Creators retain all intellectual property rights in the content they upload. By uploading, you grant Tapview a worldwide, royalty-free, non-exclusive license to host, transmit, display, and process that content for the sole purpose of operating the Service.
• You represent and warrant that you own or have the necessary rights to all content you upload, that the content does not infringe any third party's intellectual property, privacy, or publicity rights, and that the content complies with our Acceptable Use Policy.
• You are solely responsible for the accuracy of any descriptions, previews, or claims you make about your content.

6. Fees and payouts

• Tapview charges a fee of 15% of the gross transaction amount on each successful sale. This fee covers payment processing, hosting, bandwidth, dispute defense, and platform operations.
• Payouts are made on a weekly cycle (Net 7) via SEPA bank transfer, international wire, or USDC/USDT stablecoin, subject to a €25 minimum balance.
• Before your first payout you must complete identity verification (KYC) in line with EU anti-money-laundering regulations and the requirements of our payment processor, Stripe Payments Europe.
• Tapview may withhold or delay a payout if a transaction is under investigation, subject to a chargeback, or suspected of violating these Terms.

7. Buyer purchases

When a Buyer purchases content, the contract for the sale of that content is between the Buyer and the Creator. Tapview acts as a commercial agent for the Creator solely for the purpose of collecting payment. All purchases are processed in EUR unless otherwise indicated.

8. Refunds

Because all content sold through Tapview is digital and delivered immediately upon purchase, Buyers expressly waive their statutory right of withdrawal under EU consumer law (Directive 2011/83/EU, Article 16(m)) at the moment of purchase. Refunds may be granted in the cases described in our Refund Policy.

9. Taxes

Where Tapview is required to do so under EU VAT rules, we will collect, report, and remit VAT on sales to consumers in the EU. Creators are responsible for declaring their Tapview earnings to their own tax authorities.

10. Suspension and termination

We may suspend, restrict, or terminate your account at any time and without prior notice if we have a reasonable belief that you have violated these Terms, our Acceptable Use Policy, or applicable law, or if your account creates undue risk to Tapview, our payment partners, or other users.

11. Disclaimers

The Service is provided "as is" and "as available." To the maximum extent permitted by law, Tapview disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of liability

To the maximum extent permitted by law, Tapview's aggregate liability for any claim arising out of or related to the Service is limited to the greater of (a) the fees Tapview has earned from your use of the Service in the twelve months preceding the claim, or (b) €100.

13. Governing law and disputes

These Terms are governed by the laws of the Netherlands. Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Amsterdam, the Netherlands, without prejudice to any mandatory consumer-protection rights you have under the law of your country of residence.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced by email or through the Service at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
